GENERAL TERMS AND CONDITIONS OF SALE

I. GENERAL PROVISIONS

These are the Terms and Conditions of the company SEINE ALLIANCE SAS located Port de Grenelle, PARIS 75015, referred to as “the Company”, which is responsible for the operation of the James and its e-boats. Confirmation of the reservation by the Client indicates acceptance, without reservation, of these General Terms and Conditions of Sale. The Company will not be held liable for the consequences of any breach hereof, without prejudice to any damages that it may claim as a result of any loss suffered on account to this breach.

II. RESERVATION / PAYMENT TERMS

1. Provisional Reservation
You can make a provisional reservation with our sales teams, which gives you priority until your reservation is confirmed by a 50% down payment. If another client expresses an interest in the boat on the same date and at the same time, you will be duly informed and will have 48 hours to confirm your reservation with the down payment.

2. Reservation
Reservations only become definitive after receipt of the 50% down payment, accompanied by the estimate or contract signed by the client. Only this signed estimate or contract, accompanied by the General Terms and Conditions of Sale, is binding on the Company.

3. Invoicing and payment
The balance of the general invoice must be paid to the Company prior to the reservation date. Failing that, payment of the balance will be paid at the time of embarkation, by bank card only. Any extras (overtime, additional consumption, etc.) must be paid at the end of the cruise.
The cruise price includes private hire of the boat, the crew, the fuel and the services included in the signed contract.

4. Non-payment on the date of hire
The Company reserves the right to cancel the rental, without prejudice, in case of non-payment of the full cost of the services ordered.

III. CANCELLATION / POSTPONEMENT

1. By the Client
Cancellation by email at least 72 hour prior to embarkation: the 50% down payment will be refunded in full.
Cancellation within 72 hours of embarkation: the 50% down payment will not be refunded.

2. By the Company
For any reason whatsoever, other than:
– non-payment of the sums owed by the Client,
– a force majeure event,
– a police services directive governing navigation on the Seine.
In the event of cancellation by the Company, the Client will receive a full refund for all sums paid, down payments and balances. In no case will cancellation by the Company give rise to the payment of compensation or damages.

3. Postponement
In case of forecast of poor weather conditions (rain, snow, storm, etc.), the client can postpone the cruise up to 24 hours prior to departure and select a new day with the sales team.

IV. RENTAL REGULATIONS

1. No hazardous materials are permitted on board our boats.
2. The Company will not be held liable in case of loss of or damage to clothing, luggage or items taken on board by clients or their guests. The Company will not be held liable for any item that falls into the water.
3. The Company reserves the right to invoice the client for any damage caused to the boat by the client or a member of their group.
4. To avoid delay, it is imperative that the client and their guests arrive 15 minutes prior to departure. Any delay on the part of clients will be deducted from the cruise time.
5. The Company will make every effort to ensure that the cruise takes place under the terms and conditions provided for in the reservation. In no case will it be required to pay compensation in case of modification of the itinerary or timetable, or cancellation of the cruise, in respect of the navigation regulations imposed by the General Police Regulations.
6. The Company will not be held liable for any injury to passengers occurring during the cruise where this is caused by one of the following so-called force majeure causes: flash flood, storm, collision with another boat, even partially responsible for the accident, or any other unforeseeable event.
7. Passenger obligations: from embarkation, each passenger must immediately and strictly follow the instructions of the captain.

VI. APPLICABLE LAWS

In case of dispute or contention, only the French courts will have jurisdiction and only French law will apply. Disputes with commercial companies will be submitted to the Commercial Court of Paris.
